It doesn't matter, but the fact is, these bans arise whenever the game client gets disconnected or lagged.

I always get dc'ed, yet my account has yet to be banned.

That's not really true. To have a bot be able to know if you're hacking or not, let alone walk around maps search for hackers would require artificial intelligence, and maplestory probably don't have that. The auto-ban is built into the server code base, and it calculates your max possible hit with your armor worn, and it recognizes your damages. Also, it keeps track of your attack speed, number of times you've attacked and not been hit, and if you moved the monsters. This is similar to the private server auto-ban, except much more efficient, better, and more complicated.

It's definitely not better. The false bans are unbelievably high.

I already know of one way MapleStory could fix this: timestamp the packets, that way if there is lagging, the timestamp will be there to prove they weren't sent all at once. But then again, the hackers would just add timestamp tampering to their arsenal of hacks.

Actually, it IS better. Just not a whole lot.
